Rent guarantee insurance in Spain: what every non-resident landlord must know
An eviction procedure in Spain (desahucio) takes 6 to 18 months on average. For an overseas landlord managing remotely, rent guarantee insurance is not an option — it is a necessity. Here is everything you need to know.
Rent guarantee insurance (called seguro de impago de alquiler or GLI in Spain) is one of the subjects overseas landlords underestimate most — until the first default. In the US, Canada and the Netherlands, landlord protection mechanisms differ significantly from Spain’s. In Spain, everything runs through private insurers. And an eviction, when it runs its course, can cost you the equivalent of one to two years of management fees.
Here is how Spanish rent guarantee insurance works, what it really covers, and how to choose between a standalone policy and one integrated into your management mandate.
01Why rent guarantee insurance matters especially in Valencia
In Spain, the right to housing is constitutionally protected, and eviction proceedings — even for clear-cut non-payment — are structured to protect tenants. For a landlord managing remotely, this translates into:
- Long timelines: from the first missed payment to physical eviction, allow 6 to 18 months depending on the local court
- High costs: lawyer (letrado + procurador), court fees, sometimes property restoration — the total can exceed €5,000–8,000
- Impossible to manage remotely without a local representative: proceedings are entirely in Spanish before local courts
- Zero income during the procedure: the property is occupied but generating nothing
Rent guarantee insurance transfers this risk to the insurer. You continue receiving replacement income during the procedure, and legal costs are covered.
02What rent guarantee insurance covers in Spain
Standard cover
- Unpaid rent: most policies cover 12 to 18 months of unpaid rent from the date the claim is declared
- Legal costs: lawyer and procurador fees, desahucio court procedure costs
- Property abandonment: covered by most policies (tenant leaves without notice or payment)
Optional or variable cover depending on the policy
- Property damage: repair of damage caused by the tenant beyond the security deposit (often subject to a cap)
- Restoration costs: cleaning, lock replacement, fixture replacement after eviction
- Broader legal protection: lease renewal disputes, tenant counterclaims, etc.
⚠️ Watch out for the waiting period
Most Spanish rent guarantee policies have a waiting period (período de carencia) of 1 to 3 months after taking out the policy, during which no claim can be made. You must take out the policy before the tenant moves in — or integrate it from the start of the letting process.
03Cost and eligibility
The cost
A Spanish rent guarantee policy costs between 2.5% and 4% of annual gross rent. On a €1,000/month rent:
- At 2.5%: €300/year — €25/month
- At 3.5%: €420/year — €35/month
- At 4%: €480/year — €40/month
For EU resident landlords (Dutch, French, etc.), this cost is deductible from the IRNR taxable base, reducing your Spanish income tax. US residents taxed on gross rent get no Spanish deduction, but the premium still reduces your actual risk exposure.
Tenant eligibility criteria
Insurers always require a tenant solvency assessment before granting cover. Standard criteria:
- Net monthly income ≥ 3× the rent (sometimes 2.5×)
- Stable employment (permanent contract preferred) or solid self-employment documentation
- No listing on Spanish credit default registers (ASNEF, RAI)
- No history of previous tenancy disputes
If the tenant’s file does not pass the insurer’s filter, the policy cannot be taken out for that tenant. This is an additional reason to vet applicants thoroughly from the start.
04Integrated vs standalone: which to choose?
| Criterion | Standalone policy | Integrated into management |
|---|---|---|
| Cost | 2.5–4% of annual rent | Included in fees (12–15% excl. VAT) or slight uplift |
| Claims management | Your responsibility (declaration, follow-up, proceedings) | Handled entirely by the agency |
| Point of contact | You + insurer + lawyer | One: the agency |
| Flexibility | Free choice of insurer and cover levels | Agency-negotiated contract |
| Best for | Locally-based landlords who manage themselves | Overseas landlords managing remotely |
For a landlord based in the US, the Netherlands or elsewhere abroad, the integrated option is almost always preferable. In the event of a default, you do not have to coordinate a Spanish lawyer from across the world or follow a procedure in Spanish — the agency handles everything and keeps you updated.
05How to file a claim in Spain
- Immediate friendly reminder: from the first day of non-payment, contact the tenant in writing (WhatsApp + email + registered letter)
- Declare the claim to the insurer: generally within 30 days of the first missed payment (contractual deadline — check your policy)
- Formal legal notice: burofax (Spanish registered letter with proof of delivery and content) drafted by the insurer’s lawyer
- Desahucio proceedings: if the tenant does not regularise, legal proceedings are initiated — the insurer covers the costs
- Replacement rent payments: during the procedure, the insurer pays the missed rent up to the contractual cap

Frequently asked questions
How much does rent guarantee insurance cost in Spain?
Between 2.5% and 4% of annual gross rent — €300 to €480/year on a €1,000/month rent. Deductible from IRNR for EU resident landlords.
What does rent guarantee insurance cover in Spain?
Unpaid rent (12–18 months depending on the policy), eviction procedure costs (lawyer, procurador, court fees), and property abandonment. Many policies also cover property damage beyond the security deposit.
Is it better to have the insurance integrated or standalone?
For an overseas landlord, integrated is almost always the better choice: one point of contact, rate often negotiated by the agency, and full claims handling. A standalone policy may be cheaper but leaves you managing a Spanish legal procedure from abroad.
Does it cover a tenant who leaves without paying?
Yes. Most Spanish policies cover abandonment. You generally need to declare the claim within a defined period after the first missed payment — check this deadline in your contract.
