Rent arrears in Valencia: what to do when a tenant stops paying

A missed rent payment is stressful. A missed rent payment when you’re 2,000 km away and don’t speak Spanish is worse. Here are the exact steps, realistic timelines and cost estimates — and what you should have set up before this ever happens.

Spain’s eviction process is slower than most Northern European or US landlords are accustomed to. That is simply the reality. A contested desahucio takes 6–18 months, during which you may receive no rent. But the process is legal, structured and — with the right protections in place — financially covered.

Here is the complete picture.

01First missed payment: do not wait

The most common mistake overseas landlords make is waiting too long to act. A late payment that might be a simple bank error can also be the start of a sustained default. The cost of acting a month too late is one extra month of arrears that you may never recover.

On the day rent is due and not received, your property manager should:

  • Contact the tenant by phone or email — a friendly reminder, in case it is genuinely a bank issue
  • Request payment within 2–3 working days
  • If no payment and no credible explanation: escalate immediately to the formal procedure

Do not give multiple informal extensions without written agreement. Spanish courts look at documented steps taken — the earlier your paper trail starts, the stronger your position.

02The burofax: your first official step

A burofax is a certified registered demand sent through Correos (Spain’s postal service) that provides legal proof of delivery, date and content. It is the standard first formal step in any Spanish rent arrears case.

The burofax formally notifies the tenant:

  • The amount owed (rent + any charges)
  • A demand for payment within a short period (typically 10 days)
  • Notice that legal proceedings will follow if payment is not made

Cost: approximately €15–25 at a Correos office. Worth every cent as evidence.

If the tenant pays within the burofax period, the matter ends there. If not, proceed to the legal route.

03The desahucio procedure: realistic timeline

Month1
Rent missed — amicable approach

Phone/email contact. 3–5 day payment deadline. Burofax sent if no response.

Month1–2
Lawyer engaged — claim filed

Hire a Spanish lawyer specialising in tenant law (or GLI insurer appoints one). Claim filed with local court (Juzgado de Primera Instancia).

Month2–5
Court notification to tenant

Court notifies tenant. Tenant has 10 business days to: (a) pay the full debt, (b) vacate voluntarily, or (c) contest the claim. Option (a) ends the process.

Month4–10
Hearing (if contested)

If the tenant contests, a full hearing is scheduled. Duration varies — 2–8 additional months depending on court backlog. Valencia courts: medium load.

Month6–18
Eviction order executed

Court issues order. Comisión judicial (court officer + locksmith) carries out physical eviction. Property returned to landlord.

In practice: uncontested cases in Valencia typically resolve in 4–8 months. Contested cases: 10–18 months. These are realistic averages, not worst-case scenarios.

04Estimated costs of an eviction without insurance

Cost itemEstimated amount
Lawyer fees (desahucio)€800–1,500
Court fees (tasas)€150–250
Procurador (court agent)€200–400
Lost rent (8–12 months)€8,000–14,400 at €1,200/month
Property restoration (if applicable)€500–3,000
Total potential loss€10,000–20,000

This is the real cost of one bad tenant without GLI coverage. Against this, a rent guarantee insurance policy at €300–480/year on a €1,000/month property looks like what it is: essential infrastructure, not optional.

💡 What GLI insurance actually covers

A standard Seguro de Impago (GLI) policy kicks in from the first missed month and continues paying throughout the eviction — typically covering 12–18 months of rent and all legal costs. The insurer manages the eviction process and appoints the lawyer. You receive your rent each month regardless of what the tenant does. For an overseas landlord, this is the single most important protection you can have.

05What makes evictions faster (or slower)

Factors that speed things up:

  • A clean, LAU-compliant lease with all clauses properly drafted
  • Immediate burofax — no delay in starting the paper trail
  • GLI insurer managing the legal process (they have experienced lawyers and know the local courts)
  • Tenant does not contest (leaves voluntarily after court notification)

Factors that slow things down:

  • Informal lease or verbal agreement (seriously weakens your legal position)
  • Weeks of delay before taking formal action
  • Vulnerable household designation (Ley de Vivienda 2023 provisions) — potential procedural delays if a social services report is requested
  • Contested claim with tenant represented by a lawyer

🇺🇸 US investors: the liability comparison

The Spanish eviction timeline compares unfavourably to some US states (Texas: 2–4 weeks; Florida: 2–5 weeks) but comparably or better than California (4–6 months) or New York (8–18 months). The key difference: Spanish tenant protections don’t vary by city — the national LAU applies uniformly. Valencia courts are not as backlogged as Madrid or Barcelona, making Valencia one of the faster Spanish jurisdictions in practice.

06The three protections that make this manageable

Three measures, implemented at lease signing, eliminate the financial sting of most default situations:

  • Rigorous tenant vetting: 3× income ratio, ASNEF check, employment contract type, previous landlord reference — reduces default probability significantly
  • Rent guarantee insurance (GLI): covers rent income during eviction + legal costs. The cost over 5 years is far less than a single eviction event.
  • A local property manager: acts immediately at first sign of default — no communication lag, no language barrier, no missed burofax deadline

None of these makes default impossible. Together, they make it financially manageable and procedurally handled — without you needing to be in Valencia.

Frequently asked questions

How long does eviction take in Spain?

6–18 months is the realistic range. Uncontested cases in Valencia typically resolve in 4–8 months. Contested cases: 10–18 months. Valencia courts are moderately busy — neither the fastest nor the slowest in Spain.

What is a burofax and why does it matter?

A legally certified registered demand sent through Correos. It provides proof of delivery, content and date — essential as evidence in court proceedings. Sent by the landlord or manager when informal payment demands fail. Cost: €15–25.

Does rent guarantee insurance cover the eviction period?

Yes — most GLI policies cover unpaid rent from the first missed month through the eviction process, typically 12–18 months. They also cover legal fees. This is the most important financial protection an overseas landlord can have in Spain.
